10.1 In order to procure Services on this Website and to use certain other parts of the
System, you are required to create an Account which will contain certain personal details and
Payment Information which may vary based upon your use of the Website as We may not require payment

period from the commencement of the provision of services until the date you notified us and may be
charged for a billing cycle of one month.

11. Termination and Cancellation of Accounts
- 11.1 Either Gairn Inspection Limited or you may terminate
your Account. If We terminate your Account, you will be notified by email and an explanation for the
termination will be provided. Notwithstanding the foregoing, We reserve the right to terminate
without giving reasons.
- 11.2 If We terminate your Account, any current or
pending orders or payments on your Account will be cancelled and provision of Services will not

- 12.1 Whilst every effort has been made to ensure
that all general descriptions of Services available from Gairn Inspection Limited

Services that will be provided to you, We are not responsible for any variations from these
descriptions as the exact nature of the Services may vary depending on your individual requirements
and circumstances. This does not exclude Our liability for mistakes due to negligence on Our part

- 12.2 Where appropriate, you may be required to
select the required Plan of Services.
- 12.3 We neither represent nor warrant that such
Services will be available at all times and cannot necessarily confirm availability until confirming
your Order. Availability indications are not provided on the Website.
- 12.4 All pricing information on the Website is
correct at the time of going online. We reserve the right to change prices and alter or remove any
special offers from time to time and as necessary.
- 12.5 In the event that prices are changed during
the period between an order being placed for Services and Us processing that order and taking
payment, then the price that was valid at the time of the order shall be used.

14. Cancellation of Orders and Services
We want you to be completely satisfied with the Products or

any Specific Terms accompanying the Service contain terms about cancelling the Service, the cancellation
policy in the Specific Terms will apply.
- 14.1 If you are a consumer based within the
European Union, you have a statutory right to a “cooling off” period. This period begins once your
order is confirmed and the contract between Gairn Inspection Limited and you is formed and ends at the end of
14 calendar days after that date. If you change your mind about the Services within this period and
wish to cancel your order, please inform Us immediately using the following email: firstname.lastname@example.org. Your right to cancel during the
cooling off period is subject to the provisions of sub-Clause 14.2.
- 14.2 As specified in sub-Clause 13.6, if the
Services are to begin within the cooling off period you are required to make an express request to
that effect. By requesting that the Services begin within the 14 calendar day cooling off period you
acknowledge and agree to the following:
14.2.1 If the Services are fully performed within the 14 calendar day cooling off
period, you will lose your right to cancel after the Services are complete.
14.2.2 If you cancel the Services after provision has begun but is not yet complete
you will still be required to pay for the Services supplied up until the point at which you
inform Us that you wish to cancel. The amount due shall be calculated in proportion to the
full price of the Services and the actual Services already provided. Any sums that have
already been paid for the Services shall be refunded subject to deductions calculated in
accordance with the foregoing. Refunds, where applicable, will be issued within 5 working
days and in any event no later than 14 calendar days after you inform Us that you wish to

Facilities will be free of defects and / or faults and we do not provide any kind of refund for
outages. We provide no warranties (express or implied) of fitness for a particular purpose, accuracy
of information, compatibility and satisfactory quality.
- 19.2 We accept no liability for any disruption or
non-availability of the Website resulting from external causes including, but not limited to, ISP
equipment failure, host equipment failure, communications network failure, power failure, natural
events, acts of war or legal restrictions and censorship.
20. Limitation of Liability

accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including

Gairn Inspection Limited and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

You (the “Learner”) should read these Terms and Conditions carefully before purchasing any e-learning courses (the “Product”).

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service or Product. The following explain you who we are, how we will provide Products to you and what responsibilities remains with you. Purchases, Pricing and Payment
Prices of the Products are set by Gairn Inspection Limited solely and there has been no request, advice or recommendation from the partner(s), sponsor(s) or designer(s).
Gairn Inspection Limited reserve the right to review and amend the pricing of any of our products, regardless they are sold individually or under corporate options. Any price changes of products will not affect products that have already been purchased.
To complete the payment at the point of purchase, Gairn Inspection Limited use third party payment provider (WorldPay). If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase to our third party payment provider (WorldPay) including, without limitation, your credit card number, the expiration date of your credit card, your billing address.
By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.
We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. You expressly agree that Gairn Inspection Limited cannot accept any liability for loss or damage arising out of such cancellation.

On acceptance and compliance to these Terms, you agree to complete the payment for the Products in the specified currency (Great Britain Pound, GBP). The Learner will be accountable to pay any applicable conversion charges, in addition to relevant tax(s) in your country or region.
Gairn Inspection Limited will not be able to provide a refund if the Learner fail to complete the content.
Availability, Errors and Inaccuracies
We are constantly updating our offerings of products and services on the Service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other web sites. You expressly agree that any such offer of a product or service does not constitute a legal offer capable of attracting legal consequences.

When you create an account with us, Your account will generated in our Learning Management System (Moodle) and you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trade mark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene. You expressly agree that we cannot be held liable for any loss or damage arising out of any misrepresentations you make in this regard.
Gairn Inspection Limited grant you (the Learner) a licence to use the purchased e-learning course (the Product) after you completed the payment at the point of purchase.
Any licences is subject to the rights and obligations granted under these Terms and Conditions. Licences are non-transferable, limited, non-exclusive, non-sublicensable, and revocable. Every licence is personal and specific to a Learner and cannot be shared or exchanged with others. The Learner or the employer of the Learner are not allowed to transfer licences under these terms to someone else.
Where end date is not specified, the licence to use the purchased e-learning course (the Product) may not include an end date. We cannot and do not guarantee the duration to access to the purchased course for any reasons.
You shall not copy, distribute, modify, or in any way exploit the e-learning courses (the Products) or any other copyrighted materials or services provided by Gairn Inspection Limited. The Learner shall also not allow anyone else to copy, distribute, modify, or in any way exploit the Products or any other copyrighted materials.
We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes the copyright or other intellectual property infringement (“Infringement”) of any person.
If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through the Service, you must submit your notice in writing to the attention of “Copyright Infringement” of firstname.lastname@example.org and include in your notice a detailed description of the alleged Infringement.

All Intellectual Property Rights in the eLearning course materials remain the intellectual property of Gairn Inspection Limited. In this case, Intellectual Property Rights includes but not limited, copyright, rights in or relating to contents, photos and voiceover, designs, photos, graphs, schematics, charts, trademarks, know-how, processes, methods, business plans or models rights in or relating to Confidential Information and other intellectual property rights (registered or unregistered) throughout the world. All the above rights shall exclusively be owned by Gairn Inspection Limited.
Course Assessment and Certificate of Completion
Course assessments are subject to these terms and conditions. the Learner must complete the course assessment to receive the course certificate of completion, if applicable. To complete the course assessment, the Learner means must reach to the minimum score or pass mark specified at the learning management system. Gairn Inspection Limited will not be able to refund or cancel the purchased product if the Learner fails to complete the course assessment.
Certificate of completion of the product will be designated to that specific product. The product certificate of completion will be subject to these terms and conditions. The product certificate of completion will be expired after 2 years of the date when assessment has been completed. Gairn Inspection Limited will not be able to accept any responsibilities on mis-use of the certificate of completion the Learner or employers.
Links To Other Web Sites
Our Service may contain links to third-party web sites or services that are not owned or controlled by Gairn Inspection Limited.
Gairn Inspection Limited has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Gairn Inspection Limited shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Restriction Policy and Cancellation
You will not have the right to reverse the product purchase or cancel the purchase. You will be liable to ensure that your system requirements are met before purchasing any product. The system requirements may include but not limited to Internet connection, compatible software and well-matched device. Product(s) will be only available on the desktop and tablet devices and mobile phone devices are not included. Gairn Inspection Limited will not deliver refunds where system requirements of Learner are inadequate.
If payment for the Product(s) has failed for any reason or inaccurate information has been provided during registration, Gairn Inspection Limited have the right to restrict the access to the Products for the Learner or Learners.
You agree to defend, indemnify and hold harmless Gairn Inspection Limited and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You can only bring legal proceedings in either the Scottish or English courts.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 7 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Gairn Inspection Limited provide Learners with login details to access the Learning Management System (LMS) and the Product following successful completion of payment at the point of purchase. If the access to LMS is faulty, then you are entitled to enquire for a fix and if the fault cannot be repaired, then you can request refunding of some or all of your money.
